Separation
Before a dissolution of marriage can occur, the couple often separates. Separation allows both parties to either reconcile or proceed with the divorce. There is no time requirement for a couple in Missouri to be separated. If they decide to divorce, the next step would be filing a petition with the court.
Filing of Petition
When a couple separates and agrees that divorce is their next step, a petition for dissolution of marriage must be filed. The petition must be filed with the court along with a court fee and other required forms that vary based on the county in which it’s filed.
Service of Process
Once the petitioner (the spouse who legally starts the divorce process) files the petition with the court, the respondent (the other spouse) must be notified. Missouri allows papers to be served by Entry of Appearance and Waiver of Personal Service, personal service by the sheriff or private or special process server, or by publication.
Temporary Motion or Hearing
Next is a temporary motion or hearing, a great way to set some legal terms in place while the divorce is pending. Things like child support, custody arrangements, and who is responsible for bills are some things that can be temporarily settled with the court until the divorce is final.
Settlement Agreement
Outlining what each party is responsible for post-divorce, both parties must accept the settlement agreement, and the court must find it acceptable. Terms like legal and physical custody, child support, and spousal maintenance will be indicated in the settlement agreement.
Mediation
A great way to resolve issues without both parties having to be in a courtroom setting, mediation is a non-binding, confidential process that occurs with a neutral third party and both spouses’ attorneys. Mediation can save the parties time and expenses compared to trials.
Trial
Every divorce case is unique - some complex cases may need to go to court and be settled by a judge. If the divorce case must be settled in court, your attorney will work with you to gather and present evidence as it pertains to your case.
